r conspiracy to commit a violation of section 136b of Act No. 328 of the Public Acts of 1931, being section 750.136b of the Michigan Compiled Laws.Definitions of Abuse and Neglect. Abuse and Neglect of a consumer is categorized into classes. Class 1 Abuse is throwing an object at a consumer, choking a consumer, using a weapon on a consumer, sexually molesting a consumer in any way, or giving a consumer non-prescribed drugs or alcohol. Class 2 Abuse means that an nonaccidental act, or provocation of another to act, by an employee which causes nonserious physical injury to a consumer, or the unreasonable use of force by an employee against a consumer with or without apparent injury. Examples would be a staff hitting, pinching, kicking, or using unnecessary roughness toward a consumer. All classes of abuse refer only to those acts done to the consumer by an employee or other person authorized to provide care or supervision for the consumer. Class 1 Neglect means noncompliance by an employee to give the standard of care or treatment required by law, rules, guidelines, procedures, or written directives which may cause serious injury to a consumer. Examples of this: a staff permitting a consumer to yield a weapon, allowing a consumer to bang their head, permitting a consumer to commit suicide, allowing a consumer to burn himself/herself with a cigarette. Class 2 Neglect would refer to ignoring a consumer request, failing to change a consumer dressing or diaper, permitting a consumer to bite him or herself, starve themselves, or eat nonedibles. Class 3 Neglect would refer to staff not locking the medicine cabinet, staff not buckling seatbelts of consumers, staff not securing wheelchairs of consumers in a vehicle, or staff leaving the home unattended.
